CAVEATS.

If you are thinking of lodging a caveat on a property it is important that you are legally able to do so. You must have a caveatable interest.In simple terms there must be a link to your legal claim and the property. For example you may have made improvements to the property, assisted in purchasing the property even though your name is not on the title or have an agreement that states you have an interest in the property as security. There are many examples. Each case is different.

A property owner can apply to the supreme court to have the caveat removed. They will need to argue you do not have a caveatable interest. If they are successful they can obtain a court order for you to pay legal costs.
